ElevenReader Terms

These ElevenReader Terms (“ElevenReader Terms”) supplement the ElevenLabs Terms of Service (the “Terms of Service”) and, together with the Terms of Service, apply to your use of ElevenReader (defined below). For clarity, notwithstanding anything to the contrary in any existing agreement that you may have with ElevenLabs, these ElevenReader Terms exclusively govern your use of ElevenReader. Your use of ElevenReader is also subject to our Prohibited Use Policy and our Privacy Policy. Defined terms used in these ElevenReader Terms have the meanings set forth in the Terms of Service.

Please read these ElevenReader Terms carefully. By using ElevenReader you agree to these ElevenReader Terms. If you do not agree or do not have the authority to agree, you are not permitted to use ElevenReader. These ElevenReader Terms constitute a legally binding contract between you and ElevenLabs. In case of any conflict between these ElevenReader Terms and other terms agreed upon between you and ElevenLabs, these ElevenReader Terms shall prevail solely with respect to your access or use of ElevenReader. 

CERTAIN ELEVENREADER SERVICES ARE OFFERED ON A SUBSCRIPTION BASIS AND AUTOMATICALLY RENEW UNLESS CANCELLED IN ACCORDANCE WITH THESE ELEVENREADER TERMS. BY ENROLLING IN A SUBSCRIPTION, YOU AUTHORIZE RECURRING CHARGES UNTIL CANCELLATION. SEE SECTION 5 (SUBSCRIPTIONS, HOURS, & PAID FEATURES) FOR FULL DETAILS.

THESE ELEVENREADER TERMS CONTAIN VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTION 5(k).

1. ELEVENREADER. “ElevenReader” is a service provided by ElevenLabs, functioning as a mobile and web application, that enables the creation and playback of audio content derived from written text, from any available source, and includes all features, functionalities, associated software, and any updates or modifications thereto, that facilitate the generation and consumption of audio content from text. By using ElevenReader, you acknowledge and agree that you are (A) at least 18 years of age and (B) using the service for your personal and non-commercial use, unless you are participating in our Publishing Program (as defined below) or are publishing to ElevenReader via Studio (as defined below). “Studio” is a service offered by ElevenLabs that enables the generation of audio content from your written text and it includes various features including the ability to publish content to ElevenReader. 

2. ELIGIBILITY & USE RESTRICTION.

a. If you are under 18 years of age, you may not use ElevenReader.

b. While certain content available on ElevenReader may be suitable for younger audiences, ElevenReader is not designed for, or directed at, individuals under the age of 18.

c. Your ElevenReader account is personal to you and may not be shared with others. You are responsible for maintaining the confidentiality of your ElevenReader login credentials and for all activity under your account. You agree not to share your account or allow others to access the Services using your credentials. Any unauthorized use may result in suspension or termination of your account. If you believe your account has been compromised, please notify ElevenLabs immediately. ElevenLabs reserves the right to investigate suspected credential misuse or unauthorized access. If ElevenLabs determines that account sharing or credential abuse has occurred, ElevenLabs may suspend or revoke access to the Services and forfeit associated Hours (as defined below).

3. USER GENERATED CONTENT & CONTENT LICENSING. 

a. By submitting any Input through ElevenReader, you represent and warrant that you own, control, or have obtained all rights, licenses, consents, permissions, power and/or authority necessary to submit and use (and allow ElevenLabs to use) such Input in connection with ElevenReader. You further represent and warrant that your submission of Input in connection with your use of the Services, including to generate Output, will not violate any applicable law or any third party’s terms, conditions or rights associated with such Input. You acknowledge and agree, that you, and not ElevenLabs, are solely responsible for all Content you upload, import, generate, or distribute via ElevenReader.

b. By uploading, importing, or generating Content via ElevenReader, you grant ElevenLabs a non-exclusive, worldwide, sub-licensable (through multiple tiers), royalty-free and fully paid to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly or otherwise perform and display, and use your Input to provide the Services (including the trust and safety features therein), to improve the Services, and to develop new services and products. For clarity, this license grant does not transfer ownership of your Content but allows ElevenLabs to enable the functionality of ElevenReader.

4. CONTENT ACCESS AND LICENSES.

a. Purchased Content; License from Publishers. When you buy Purchased Content (as defined in Section 5(g)(v) below), you obtain a license to access such Purchased Content, not ownership of any intellectual property rights therein. Purchased Content is licensed to you by the applicable Publisher (as defined below) and made available via ElevenLabs as the platform provider. All title, ownership, and intellectual property rights in Purchased Content remain with the Publisher and/or its licensors. For clarity, the ElevenReader user interface may describe a transaction as a “purchase” or similar designation, but for the avoidance of doubt, all such transactions convey a license to access Purchased Content as described in herein and do not transfer ownership. As used herein, “Publisher” means the applicable publisher or author licensing the Content or Purchased Content to you, and includes any such rights holder that has authorized ElevenLabs to facilitate or distribute the license via ElevenReader.

b. License Grant and Scope. Subject to the ElevenReader Terms and any usage limits disclosed at the point of purchase, your license to Purchased Content is personal, limited, revocable, non-exclusive, and non-transferable. The license permits access and streaming of the Purchased Content within ElevenReader for your private, non-commercial use. To the extent Offline Mode is enabled for your plan or item, you may temporarily download Purchased Content for offline playback within ElevenReader; any such download is part of, and limited by, the same license. 

c. Restrictions. You may not reproduce, redistribute, resell, publicly perform or display, broadcast, make available outside ElevenReader, or sublicense Purchased Content. You may not attempt to bypass, modify, or interfere with digital rights management, technical protection measures, or usage controls. Device, account, and territorial restrictions may apply and will be disclosed within ElevenReader where relevant.

d. Content Changes; Catalog Removals. We may modify, suspend, or remove Content from the ElevenReader catalog at any time, including for fraud, abuse, policy violations, licensing restrictions, or actual or suspected infringement, or to comply with law, court orders, or requests from rights holders. If a Purchased Content item is subsequently removed from the catalog, you will retain access to the specific Purchased Content you previously purchased under your account, except where continued availability would be unlawful, required to be removed by law or by a valid third-party claim, or otherwise prohibited by a platform or rights holder requirement. Nothing in this Section prevents ElevenLabs from disabling features, correcting errors, or making updates to Purchased Content where reasonably necessary. 

5. SUBSCRIPTIONS, HOURS, & PAID FEATURES.

a. Subscription Tiers and Hours System. ElevenLabs offers a range of subscription plans and one-time purchases through ElevenReader that grant access to certain features through a character-based usage system denominated in hours (“Hours”). Hours may be used to generate and listen to audio content within ElevenReader, including playback of content you create or import. Each plan provides a fixed number of Hours per period (e.g., weekly or monthly), and may display estimated usage in terms of hours or minutes for convenience. However, for clarity, Hour usage is calculated based on the number of characters processed – not the actual duration of playback. This means that listening at faster speeds or completing content more quickly does not conserve or reduce Hour consumption. The “hours-per-month” or “hours-per-week” references are estimates provided only for convenience and do not affect how Hours are consumed or the underlying character-based usage calculation. Hours may be earned, purchased, or received through a subscription plan, and any applicable Hours allocation, rollover policies, entitlements, and usage rules or limits for each plan are described herein and at https://elevenreader.io/pricing, as may be updated from time to time (the “ElevenReader Pricing Page”) (which is incorporated by reference). Purchases and subscriptions are processed via the applicable App Store, third-party payment processor, and ElevenLabs’ third-party billing infrastructure. For any plan described or marketed as “unlimited,” you acknowledge and agree that such usage is subject to a reasonable use cap of up to twenty-four (24) hours of generated audio per calendar day, calculated at standard (1.0x) playback speed - this threshold reflects the maximum reasonable daily listening capacity of an individual user and is designed to preserve platform stability and fair access for all users. Details of any reasonable use caps applicable to plans described as “unlimited” are set out on the ElevenReader Pricing Page and are incorporated by reference. Please review the applicable caps before purchasing. ElevenLabs may monitor usage and take appropriate action, including suspending or restricting access, in cases of excessive use or other misuse.

b. Free Plan. Users under the Free Plan receive a limited number of Hours each month. These Hours reset automatically every thirty (30) days and do not roll over unless explicitly stated otherwise. Additional Hours may be earned by completing specified actions within ElevenReader, such as referring friends or maintaining a listening streak. For clarity, Hour consumption is based on the number of characters processed and not on real-time listening duration - and faster playback does not conserve usage. ElevenLabs may modify the available actions or reward structures at its discretion. ElevenLabs may adjust Free Plan allocations, accrual rules, or reset cadence from time to time, and will provide notice in ElevenReader prior to the effective date.

c. Paid Subscriptions. ElevenLabs offers paid subscription plans (e.g., Ultra) through both (i) App Stores (e.g., Apple App Store or Google Play), and (ii) our web application using a third-party payment processor (e.g., Stripe). The length of your recurring subscription will be provided when you make your purchase. Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on your selection) unless canceled at least twenty-four hours before renewal. By subscribing, you authorize your applicable payment processor to charge your account for the subscription fee and any applicable renewal periods. In the event that ElevenLabs is unable to charge your payment method(s) as authorized by you when you enrolled in a subscription plan, ElevenLabs may in its sole discretion either suspend your access to the subscription plan until payment is received or seek to update your payment method information through third-party sources (i.e., your bank or a payment processor) to continue charging your payment method as authorized by you. Each paid plan includes: (w) a set number of monthly Hours; (x) access to features such as Offline Mode, Premium Content, and other benefits as described in ElevenReader; (y) Hours issued under a paid subscription plan that expire twelve (12) months after they are issued if unused; and (z) no additional Hour cost for replaying previously generated content. For clarity, Hour usage is determined based on the number of characters processed and not on real-time listening duration - and faster playback does not reduce or conserve usage. The current features, pricing, and benefits for each subscription tier are available on the ElevenReader Pricing Page. Refunds are subject to Section 5(g) (Refunds and Cancellations) below. Continued use of ElevenReader after any such updates constitutes acceptance of the revised terms.

d. Add-On Hour Purchases. You may purchase additional Hours without subscribing (“Add-On Hours”). Add-On Hours expire twelve (12) months after purchase unless otherwise stated. Volume purchases may include tiered discounts.  Add-On Hours are non-refundable, non-transferable, and have no cash value, except where required by law. Refunds are subject to Section 5(g) (Refunds and Cancellations) below.

e. Price Changes. We may modify pricing for paid subscriptions or Add-On Hours purchases from time to time. If the price of your current paid subscription plan will increase, we will provide you with at least thirty (30) days advance notice using the contact information associated with your account or by displaying the updated pricing in ElevenReader before the next billing cycle, and any increase will take effect at the start of your next subscription term following notice. Changes that do not increase the price you currently pay (for example, price decreases, promotional reductions, or changes to pricing for plans you are not currently enrolled in) may take effect sooner, including before thirty (30) days have elapsed, provided we give you notice before the effective date and, in any event, before your next billing cycle. In all cases, revised pricing will be reflected on the ElevenReader Pricing Page. Continued use of the subscription after the effective date of a price change constitutes your agreement to the new price, unless applicable law or platform policies require your express consent. If you do not agree to the price change, you may cancel your subscription before the next renewal period by following the cancellation procedures described in these ElevenReader Terms. Price changes will not apply retroactively and will take effect at the start of your next subscription term following notice. From time to time, we may offer discounted introductory pricing or free trial periods for eligible users. Unless otherwise stated, subscriptions purchased through such offers will automatically renew at the then-current rate at the end of the trial or discount period, unless canceled in accordance with these ElevenReader Terms.

f. Plan Availability; Discontinuation; Grandfathering. We may introduce, modify or discontinue specific subscription plans or plan features from time to time. If we discontinue a plan from new sale, existing subscribers enrolled in that plan will continue to receive their then-current plan pricing and core inclusions through the end of the period for which they have paid. For prepaid annual subscribers, no additional charges will be imposed during the prepaid term. We may, at our discretion, provide complimentary upgrades or additional benefits (for example, enhanced perks) to existing subscribers during their paid-through period; such complimentary enhancements do not increase the price you pay, do not create any obligation for continued availability beyond the paid-through period, and may be modified or discontinued at renewal. After the paid-through period ends, we may offer you a migration to a then-available plan at the then-current price. We will provide reasonable notice of any required migration, including notice before your next billing cycle. For clarity, if any migration would increase the price you pay for your current paid subscription plan, we will provide at least thirty (30) days’ advanced notice as described in Section 5(e) above. The price for your current subscription plan will remain in force for the duration of the period for which you have already paid. After that period ends, your continued enrollment will be charged at the then-current subscription price unless you cancel as described in these ElevenReader Terms.

g. Refunds and Cancellations. 

i. Mobile App Purchases of Subscriptions or Hours. If you purchase a subscription or Hours through an App Store (e.g., Apple App Store or Google Play), your transaction is processed by the respective App Store provider. ElevenLabs does not issue refunds for these purchases. All cancellations and refunds requests must be made directly through the applicable App Store (e.g., if your purchase was through the Apple App Store, please consult the Apple App Store’s refund policy here: https://support.apple.com/en-us/118223), or if your purchase was through Google Play, please consult Google’s refund policy here: https://tinyurl.com/Google-Play-Refund-Policy). Subscriptions purchased via App Stores may be canceled at any time through your App Store account settings. For clarity, cancellation prevents future charges but does not entitle you to a refund or prorated credit for the current billing period, unused time, or Hours unless required by applicable law. Following any cancellation, however, you will continue to have access to your subscription plan through the end of your current subscription period.

ii. Web-Based Purchases of Subscriptions or Hours. If you purchase a subscription through our Website, payment is processed by our third-party payment provider. You may cancel your subscription at any time via your account settings or by contacting us by submitting a request at https://tinyurl.com/ElevenLabs-Support.  Cancellation will take effect at the end of the current billing period. Refunds are not offered for web-based subscriptions or Hours purchases unless required by applicable law.

iii. Legal Rights and Jurisdiction-Specific Protections. Nothing in this Section limits your rights under applicable consumer protection laws, including (if applicable):

(1) EU/EEA Users: If you are located in the European Union or European Economic Area and purchase a subscription or Hours via the web, you may withdraw from the purchase within fourteen (14) days of the transaction, unless you begin accessing the digital content or services during that period.

(2) UK Users: Under the Consumer Rights Act 2015, you may be entitled to a refund for faulty or misdescribed digital content. However, no withdrawal right applies after the content has been accessed.

iv. Hours Are Non-Refundable and Non-Transferable. Hours (whether earned, subscribed, or purchased) are non-refundable, non-transferable, and have no cash value, except as expressly required by applicable law.

v. Definitions; Measurement of Percentage Listened (Purchased Content). As used herein, “Refund Window” means the fourteen (14) day period from the date of original purchase. “Purchased Content” means a one-time purchase of a specific premium item or Content (as defined in the ElevenReader Publishing Terms of Service) (for example, an audiobook, series, or bundle). For clarity, for bundles or series, each constituent premium item (e.g., each audiobook within a bundle) is treated as a separate “Purchased Content” item for refund-eligibility purposes, and “percentage listened” is calculated separately for each such item. As used herein, “percentage listened” means the unique minutes (or characters) of that item streamed or played locally by the purchasing account divided by the item’s total duration/length. Replays of the same segment count only once; variable playback speed does not alter the percentage; previews and samples that are part of the item are included; deleting and re-downloading does not reset measurement; offline listening is included once the device syncs. Measurements are based on ElevenReader telemetry and server-side logs and may require device sync before processing the refund.

vi. Refund of Purchased Content. You are eligible for a refund of your Purchased Content within the Refund Window if, as of the time we process your request within the Refund Window, you have listened to less than twenty percent (20%) of the specific Purchased Content item. For bundles or series composed of multiple premium items (for example, multiple audiobooks purchased together as part of a bundle), eligibility is assessed on a per-item basis. A full bundle refund is available if each included item is below the twenty percent (20%) threshold; otherwise, refunds may be issued only for the specific eligible items in a bundle that are each below the threshold. Unless a different allocation was disclosed at purchase, any partial refund for eligible items in a bundle will be calculated on a straight-line pro-rata basis across the bundle price. Except where required by applicable law or App Store policy, refunds are discretionary and determined by ElevenLabs (or the applicable App Store for in-app purchases). ElevenLabs will make the final determination on refund eligibility for web-based purchases under these ElevenReader Terms. For in-app purchases, the applicable App Store’s policies govern refunds and decisions by App Stores are final. If a refund is granted for a Purchased Content item, your license and access to that item will be revoked when the refund is processed. Where a partial refund applies to certain items in a bundle, access to any refunded item(s) in that bundle will be revoked; non-refundable items will remain accessible. 

vii. Abuse, Limits, and Verification. ElevenLabs may deny or limit refunds in cases of suspected abuse, fraud, excessive refund frequency, chargebacks, or violation of these ElevenReader Terms. Attempts to circumvent measures (for example, disabling connectivity to avoid sync, using multiple devices or accounts to fragment listening, etc.) may result in denial of a refund. ElevenLabs may request additional information to verify eligibility and usage prior to processing a refund.

viii. Timing. ElevenLabs endeavors to process eligible refunds promptly; bank processing times vary. Certain taxes may be refunded where legally required.    

h. Managing Subscriptions. Subscriptions purchased via App Stores must be managed directly through the applicable App Store provider (e.g., Apple App Store or Google Play). Subscriptions purchased via ElevenLabs’ web application may be managed via your ElevenReader account settings or by contacting support by submitting a request at https://tinyurl.com/ElevenLabs-Support. ElevenLabs cannot cancel, modify, or issue refunds for subscriptions purchased through third party App Stores.

i. Hour Terms. Hours have no monetary value, are non-redeemable for cash, and may not be transferred or shared between accounts. ElevenLabs may adjust, expire, or revoke Hours in cases of misuse, fraud, or violation of these ElevenReader Terms or Terms of Service. Subscription-issued Hours are accessible only with an active paid subscription. If your subscription terminates or lapses, access to unused Hours is immediately suspended and may be permanently forfeited upon expiration (i.e., Hours expire twelve (12) months after purchase/issuance). Downgrading to a Free Plan similarly suspends access to such Hours, which may be reactivated only by resubscribing to a paid plan before expiration. Add-On Hours remain available regardless of subscription status, subject to their expiration period, and are not forfeited if your subscription lapses or downgrades. 

j. Modifications. ElevenLabs may modify or discontinue any subscription plan, pricing, feature or Hours-related policy upon reasonable notice appropriate to the change, which may include email, push notifications, in-app banners, or posting updates in ElevenReader or on the ElevenReader Pricing Page. For material adverse changes to features or benefits of your current paid subscription plan, we will provide at least thirty (30) days’ advance notice and such changes will take effect at the start of your next subscription term, unless otherwise required by applicable law or App Store policy. Your continued use of ElevenReader after such changes constitutes your acceptance.

j. Disclaimers and Limitations Related to Hours. Hours are a feature on ElevenReader designed to enable access to certain usage-limited or premium functionality. Hours usage is calculated as described in Section 5(a) (Subscription Tiers and Hours System) above. ElevenLabs does not guarantee uninterrupted availability of Hours or uninterrupted access to content, features, or services enabled by Hours. The rate at which Hours may be consumed may vary based on playback settings, feature usage, or future platform updates. ElevenLabs may suspend, adjust, or discontinue the Hours system at any time upon reasonable notice. Hours are non-redeemable for cash and may not be used outside ElevenReader. ElevenLabs is not liable for any loss of Hours due to account termination, inactivity, technical interruptions, or violations of these ElevenReader Terms.

k. Taxes. Prices for subscriptions, Hours, and paid features may be displayed inclusive or exclusive of applicable taxes depending on your location and platform. You are responsible for any applicable taxes, levies, or duties arising from your purchases. We may collect and remit applicable taxes where required by law.

5. PUBLISHING PROGRAM PARTICIPATION. If you choose to participate in the ElevenReader Publishing Program (“Publishing Program”), your participation is subject to the ElevenReader Publishing Terms of Service (available at: https://elevenreader.io/publishing-terms-of-service) (“Publishing Program Terms”).  By opting into the Publishing Program, you also agree to the ElevenReader Publishing Payment Terms (available at: https://elevenreader.io/publishing-payment-terms) (“Publishing Program Payment Terms”), which govern monetization, payment terms, and eligibility requirements related to publishing Content to ElevenReader. If there is a conflict between these ElevenReader Terms, the Publishing Program Terms or the Publishing Program Payment Terms, the Publishing Program Terms and Publishing Program Payment Terms shall control with respect to matters specifically related to the Publishing Program. ElevenLabs is not responsible for third-party payment disputes related to published Content.

6. TERMINATION & SUSPENSION. ElevenLabs reserves the right to suspend or terminate your access to ElevenReader if you violate these ElevenReader Terms, the Terms of Service, or applicable laws. Your App Store account may also be suspended if required by App Store policies.
